Yesterday, February 4, 2025, the DOAH Administrative Law Judge, John G. Van Laningham, made the decision that La Ola Surfside Restaurant is in violation of 6-525 of the LDC.
Respondents shall, no later than March 1, 2025, come into compliance with regulatory requirements or remove the non-compliant structure from the property. A status review hearing is scheduled for March 4, 2025, to determine status.
The magistrate will consider evidence of compliance when determining whether to impose or defer penalties. The magistrate also authorized the Town to correct the violation or remove the structure if needed as well as administrative costs of $250.
